What is a Deposition?

Depositions are one of the most useful resources for legal professionals. While not legally necessary, they prove to add a great amount of assistance when gathering evidence. As a sort of informal investigation, professionals collect a profile of facts and testimonies that are necessary for the case. Court reporters are there to record the questions attorneys pose, and answers witnesses give– which are done under oath. The reporter puts this information together into an accurate transcript to be used to later analysis.

What is the Purpose of a Deposition?

Attorneys use depositions to craft a concise narrative to be used in the courtroom. It acts as a practice session for witnesses, as they reiterate what is said during the deposition in court. But if there are holes in the deposition, attorneys can point out those discrepancies, which can cause an ordeal of problems for the story that is being put forth.

The best thing an attorney can to ensure their witness’s story is as solid as possible is is to make sure the story is consistent. The opposing counsel and any media surrounding the case want the witness to have inconsistencies, as it is highly beneficial to their own work. To avoid this, witnesses should tell the truth. They should also speak slowly and clearly when answering a question, and to let the attorney finish speaking before answering said question so they can give the most proper response. If a witness is confused about an attorney’s unclear question, there is no shame in asking for clarification, as this will help them answer as best they can.
